Seniors are healthier, more active and live longer than ever in our country's history. However, that brings with it a new set of legal concerns. People have always needed Wills and Estate Planning to handle the transfer of their assets to their children and grandchildren. Now that they are living longer, there are more issues that have arisen, including how to handle their future care. Such issues sometimes need to be included in individuals' Estate Planning, such as plans for housing, future medical care, and what to do if the person should become incapacitated. Elder Law is a relatively new specialized field of law that deals with the issues faced by the elderly, the fastest growing segment of our population. This area of law includes and combines elements of Estate Planning, Wills and Trusts, Conservatorship (also called Guardianship), Health Care Planning, Medicare/Medicaid Planning, and Elder Rights. As continuing care becomes more and more expensive, seniors need guidance and information about long-term care insurance and government benefits as well.
