We prepare from the simple to the more complex types of Wills and Trusts, Powers of Attorney. A single person might want only a Will and Powers of Attorney; or if the single person has a child or children, may desire a Trust to manage assets for a child under the age of 35. Married persons could want mutual wills and Powers of Attorney and trust provisions for children who have not attained age 35.

We can provide asset protection for children by the use of trusts so that they would not lose their inheritance, while under age 35. Over the age of 35, we hope the child has enough wisdom to protect the funds from a trust and to seek legal help if need be to obtain such protection.

Larger estates may need to have trusts between the spouses, like bypass trusts, to reduce the possibility of paying federal estate tax after the second spouse would pass on. Trusts for surviving children would usually be a part of this type of planning.

Irrevocable Trusts are sometimes utilized to keep substantial life insurance from being part of a taxable estate, while furnishing a means of supporting the surviving spouse and children. These arrangements are somewhat complicated and require steps to be taken each year to keep them up to date as to gifting and policy premiums and other details required by IRS regulations.

Other areas of practice include will contests which are expensive and yet are pursued. Wills made while a person is not competent will cause a contest. Wills cutting out children or a spouse can cause a contest as well. Trust contests are less common; trust accounting may be needed if the Trustee has not provided them. Guardianship contests are power plays between siblings usually and especially where money is involved.
